FCC Denied The Right to Fine CBS Over Janet Jackson’s Wardrobe Malfuntion janda Thursday, November 3, 2011 Credits & Debits, The Receipt, The Studio Who knew that 7 years later this was still going on??? Well for the second time since Janet Jackson’s infamous wardrobe malfunction during the 2004 Super Bowl halftime show, the 3rd U.S. Court of Appeals has sided with CBS in the FCC’s fight for the right to fine the network for airing what they deemed as a “fleeting indecency”. The FCC originally fined the network $550,000, but CBS appealed the fine and it was voided by the appeals court in 2008. Nonetheless, the FCC stood their ground, brought the case back before the appeals court but to no avail and under the same grounds as the original decision took a loss again. Maybe this time they’ll let it go! Especially considering that the half of a second airing of Jackson’s bare breast should be the least of the FCC’s concern in regards to what comes across our TV screens. IJS!!!
